Circular 55 – Termination by Municipality of Sectional Title Schemes Electricity

This week Tuesday, 3 August 2021 in the afternoon, ALA was urgently contacted by a Managing Agent, as the Ekurhuleni Municipality, had terminated the entire electricity supply to a 96 unit Scheme.
Although the Scheme was in arrears with the Municipality, the Scheme had logged queries for most of the arrears, with the Municipality.
The Scheme had also declared a dispute with the Municipality in terms of Section 95 and 102 of the Municipal Systems Act.
ALA launched an urgent application to the High Court, Johannesburg, which urgent application was heard today at 2pm.
The Judge of the urgent Court ordered the restoration of the electricity, interdicted the Municipality from cutting the electricity in the future, and ordered the Municipality to pay the Body Corporate’s legal costs.
